I-9 Leadership:
Fragomen's I-9 leadership team partners with clients to develop and deliver custom I-9 solutions to meet their unique needs, and to provide advice and counsel on all legal issues that arise in managing their I-9 compliance program. In addition to senior level attorneys and executives, each client account is supported by our HelpDesk support team, which is comprised of experienced immigration paralegals who possess extensive knowledge about I-9 compliance, and I-9 Specialists at several levels who perform process-oriented and administrative tasks.
Cynthia J. Lange, Managing Partner, chairs Fragomen's I-9 Practice Group and is a leading authority on Employer Sanctions. Currently, Ms. Lange is a member with the "Human Resources Initiative for a Legal Workforce," an expert working group of human resource professionals organized to provide Congress with principles to guide the creation of a new worksite enforcement system. Ms. Lange writes numerous articles aimed at helping employers comply with the complex legal requirements of the Immigration Reform & Control Act. Before joining Fragomen, as an INS trial attorney Ms. Lange prosecuted one of the earliest employer sanctions cases in the field and she continues to monitor judicial activity in the area. Ms. Lange has also worked on some of the largest employer sanction investigations involving both criminal and civil penalties. As part of a USCIS (formerly INS) task force, Ms. Lange participated in reviewing and evaluating new I-9 forms and proposed regulations
Ms. Lange is a graduate of Brigham Young University and Southwestern University School of Law. She has been an Adjunct Professor of Law at Southwestern University School of Law, from 1988 to present. She is a frequent lecturer on immigration law and has written articles on business immigration law matters for numerous publications. Ms. Lange is a member of the American Bar Association, the California State Bar Association, the District of Columbia Bar Association, the New York State Bar Association, the American Immigration Lawyers Association (Chairperson. National Employer Sanctions Committee, 1988-1990), the Century City Bar Association (Chairperson of the Immigration and Nationality Law Committee, 1989-1994), the Beverly Hills Bar Association, Immigration Law Section and Board of Governors (1994-1999), and Co-Chairperson of Practicing Law Institute (Annual Immigration Institute, 1998 to present).
Robert J. Horsley is Executive Director of Corporate Development and Client Services for Fragomen. In his over 13 years with Fragomen, Mr. Horsley has worked closely with many of the firm’s leading clients. His efforts are focused on the non-legal aspects of client engagement where he plays a significant role in some of the firm’s innovative approaches to strategic partnering, program design and use of client interfacing technology. He is a member of the firm’s Corporate Development, Technology and Best Practices Committees. Prior to joining the firm, Robert spent nearly a decade at what is now known as KPMG, where he served in senior management and consultant positions in the Audit, Consulting and Acquisition Advisory Groups. Mr. Horsley is a graduate of the University of Southern California Marshall School of Business.
Howard Gordon, Partner, co-manages the firm’s professional practices group, which is responsible for government relations, best practices and global information dissemination. Based in both Washington, D.C. and New York, Howard provides counsel on both government relations and complex case issues. Howard keeps in close touch with both agency officials and congressional staff. His team monitors immigration law issues and distributes alerts to clients on new developments. Howard also serves as special counsel to the American Council on International Personnel (ACIP) and works closely with other trade groups that represent Fragomen client companies, and in these various capacities provides counsel on both congressional and agency initiatives. Before joining the firm, Howard was Director of Information at AILA from 1992-1999, and was in private practice several years prior to that. Mr. Gordon is admitted to the bar in the District of Columbia and Pennsylvania, and he is a member of the American Immigration Lawyers Association.
Sarah Kelling, an Associate in Santa Clara, manages Fragomen’s I-9 Service Center. Her practice focuses on advising clients on the series of complex transactions that expose companies to risk and liability in their compliance programs. In this role, Ms. Kelling works with organizations spanning various industries including state government, financial services, technology manufacturers and agricultural producers to confront the specific I-9 challenges that arise from their particular business environment. She develops I-9 and E-Verify process workflows that maximize efficiency and minimize compliance risks while accounting for the patchwork of state compliance and employer verification requirements as well as the ever changing federal compliance and employer verification requirements. Ms. Kelling also advises organizations conducting internal “historical” paper I-9s audits and manages large scale audits (e.g. 45,000+ paper I-9s) conducted by the I-9 Service Center team, including spotting error trends and facilitating correction.
Prior to focusing on compliance matters, Sarah was responsible for immigrant and non-immigrant visa petition processing for large multi-national organizations. Ms. Kelling is admitted in California and Colorado. She is a graduate of the University of Nebraska with B.S. and J.D. degrees.
Patrick Shen, Partner and Director of Global Compliance, works with U.S. and multinational clients in maintaining compliant immigration programs from the firm’s Washington, DC office. In May of 2004, Mr. Shen became the first Director of Policy and Planning for Immigration and Customs Enforcement in the Department of Homeland Security. Before that appointment, Mr. Shen served as the Chief Immigration Counsel for the Senate Judiciary Committee. Previously, he was a trial attorney with the Department of Justice Civil Division, Office of Immigration litigation, as well as the United States Attorney's Office for the Eastern District of New York, where he received the Director's Award for Superior Performance. Mr. Shen began his legal career through the Attorney General's Honor Law Program as a law clerk for the United States Immigration Court, and later served as Assistant District Counsel for the former Immigration and Naturalization Service in New York City. Mr. Shen is admitted to the Supreme Court of Colorado, and the United States Courts of Appeals for the Second, Fourth, Fifth and Ninth Circuits. Patrick received his B.A. and J.D. degrees from Brigham Young University.

For every current employee hired after November 6, 1986, the employer must complete and maintain an I-9 form. For employees whose employment has ended, the employer must maintain the I-9 form for at least three years from the date of hire, or for one year after the employment has ended, whichever is later.
